A Curative petition is the last way to review and revise their own decision even after a review petition is dismissed or revised.  In simple words we can say it is the last option for aggrieved party to get justice as promised by Indian Constitution. The hon’ble Supreme Court originated the concept of Curative Petition in Rupa vs. Ashok Hurra.The Apex court mentioned that the court applied the concept only if there is prima facie miscarriage of justice& also clarified that an aggrieved party cannot seek it as a right. Public International Law and Private International Law There are numbers of laws in a country or nation by which the people remains disciplined and work within the laws. The law which joins one country to another is international law. The word “INTERNATIONAL LAW” was first coined by Jermy Bentham in 1780. Though International law can be traced to ancient Greece, Rome & India but it cannot be denied that international law which we know today, has come through Europe. International law can be divided into public international law and private International law.

Public International Law: Public international law is the body of legal rules, which applied between independent states. Treaties between the states entered in accordance with the rules defined in international law. Here states mean country. Every state regulates their relation with other states according to the settled law in international law. The main object behind public international law is to maintain peace and cooperation between the states.

Private International Law: Private international law is the legal guidance which regulates private relationships across the national borders. This law is called conflict of laws in US. The main object of this law is to maintain balance between sovereign actions with private sector. Examples of Private International Law: - Family law matters, Contracts, Torts etc.,

Difference Between Public International Law and Private International Law

Law Entrance Exam - CLAT

UG Programme

  • Age Limit: There will be no upper age limit for UG programme in CLAT 2020.
  • Qualifying Exam: Candidate should qualify the class 12th or equivalent exam from a recognized board or university.
  • Percentage: 45% marks in case of the candidates belonging to unreserved/OBC/specially abled person (SAP) and other categories and 40% marks in case of the candidates belonging to SC or ST categories.

CLAT 2020 Exam Pattern (Revised)

The exam pattern for CLAT 2020 is as follows:

  • Exam Mode: As per the CLAT 2020 exam pattern, the test will be held in offline mode.
  • Duration: Candidate will be given two hours to attempt the law examinations.
  • Number & Type of Questions: There will be total 150 (for UG) & 150 (for PG) of multiple choice questions.
  • Marking: Each correct answer will be awarded one mark each and 0.25 marks will be deducted for every incorrect answer.
  • Language: The questions of CLAT 2020 will be in English language only.

PU LAW(5 Year) -Entrance exams

PU BA LLB 2020 - Punjab University has released the schedule for PU BA LLB 2020 on 7th February . The application form of PU BA LLB 2020 will be released on April 1, in online mode; the last date to apply is May 1.

The UG law entrance test will be conducted on May 24, in offline mode. The entrance exam of PU BA LLB 2020 will form the basis for admissions to undergraduate law seats offered by the participating law institutes namely - UILS Chandigarh, Hoshiarpur, and UIL Ludhiana. As per the PU BA LLB prospectus, there are a total of 360 seats which includes 120 B.com seats in UILS Chandigarh and the rest of the seats will be available for BA LLB programme in all 3 participating institutes. Eligible candidates looking forward to PU BA LLB 2020 will have to apply through online application forms of PU BA LLB. Applicants who will register themselves for PU BA LLB 2020 will be issued admit cards for appearing in the PU BA LLB entrance exam.

PU LLB Entrance 2020 Eligibility Criteria
The minimum conditions that candidates have to fulfill in order to be considered for admissions to the 3-year L.L.B programme is outlined in PU LLB 2020 eligibility criteria. As per PU LLB 2020 eligibility criteria, the candidates has to meet eligibility criteria pertaining to qualifying exam, minimum marks in the qualifying exam, and age limit.

DU does not offers a five-year law programmeand National Law University, Delhi (NLUD), offer a five-year, BA LLB (H) integrated programme, which is a popular trend among students for the last few year. Student can get admission in DU five year course through CLAT only.

DU LLB Entrance Exam 2020 Eligibility Criteria

For admissions to Faculty of Law, Delhi University, candidates should meet the academic qualification and minimum marks requirements as per their categories are given below:

  • General Category: Candidates holding a graduation/ post-graduation degree from Delhi University or any other recognized Indian/foreign university with at least 50% aggregate marks.
  • OBC Category: Candidates passing graduation/ post-graduation from a recognised university with at least 45% aggregate marks.
  • SC/ST Category: Candidates passing graduation/post-graduation from a recognised university with at least 40% aggregate marks.
  • CW Category: Candidates who come under widows/ wards of ex-servicemen/serving personnel (CW) category are given a 5% marks relaxation, which means they must have obtained at least 45% aggregate marks in their qualifying degree.
  • PH Category: Candidates holding a graduation/ post-graduation degree from a recognised institute or university and minimum marks secured should be at least 45% marks in aggregate.

UGC-NET Eligibility criteria

Interested candidates appearing for UGC NET 2020 need to fulfill the eligibility criteria which are mentioned below:

  • Master’s degree from a recognized University preferably in subjects like Social Sciences, Humanities, Electronic Sciences, and Computer Science, etc.
  • Candidates appearing for the final year exam of Post graduation in the year 2020 can also apply.
  • Candidates should achieve a minimum of 55% of marks in the NET examination.
  • Candidates with a reservation should have at least 50% of the score in UGC-NET.
  • Candidates are required to appear for the subject of their qualifying exam only.
  • Candidates, whose qualifying exam subject remains uncovered in the subject list mention by UGC, are required to appear in a related subject only.

UGC NET Cut off-

University Grant Commission has set a minimum cut off score to assess the student’s knowledge. A candidate has to score at least the minimum cut off in all the papers in order to get qualified.

Eligibility for judiciary exam

Judiciary Services: The eligibility criteria for appearing in Lower Judicial Services Examination is – A person must be a citizen of India. Candidates must have been degree in LL.B or must be graduates in law.

Age limit for Punjab Judiciary

  • (i) Candidate should not be below 21 years and above 37 years of age on the last date of submission of Online application Forms.
  • (ii) Upper age limit for candidate belonging to Scheduled Castes/Scheduled Tribes of all States and Backward Classes only of Punjab shall be up to 42 years.
  • (iii) Upper age limit is relaxed up to 45 years for all States/Central Government employees.
  • (iv) Ex-servicemen of Punjab Domicile shall be allowed to deduct the period of his service in the Armed Forces of Union from his actual age and if the resultant age does not exceed the maximum age limit prescribed for direct appointment to such a vacancy in the Service Rules concerned by more than three years, they shall be deemed to satisfy the condition regarding age limit.
  • (v) Upper age limit is also relaxed up to 42 years for Widows, Divorced women and certain other Categories of Women.
  • (vi) Upper age limit is also relaxed up to 47 years for Physically Handicapped persons who have domicile of Punjab.

Judicial Magistrate exam is conducted in three stages :

  • 1. Preliminary Exam (Objective Type Multiple choice questions).
  • 2. Mains (Subjective / Descriptive).
  • 3. Viva-Voce (Personal interview)

ADA-Educational Qualifications:

The candidate should possess Degree of Bachelor of Law (Professional Degree) of a recognized university or institution & 0-2 years’ experience of practice at the Bar (Punjabi of Matric or its equivalent standard is essential).

Age limit

  • The age of the candidate should be between 18 to 37 years as on 01.01.2018.
  • DDA-Minimum Qualification

    As per District Law Officers Service Rules, 2010 the minimum qualification required for the posts of Deputy District Attorney, is as under:

    • 1. LLM or equivalent qualification from a Recognized University by HEC and five years active practice as an Advocate; or
    • 2. LLB (with 50% aggregate marks) or equivalent qualification from a Recognized University by HEC and seven years active practice as an Advocate.

    Minimum Experience: 05 years for LLM and 07 years for LLB.
    Age: Male 30 to 40+5 years and Female 30 to 40+8 years.

    DA-Minimum Qualification

    As per District Law Officers Service Rules, 2010 the minimum qualification required for the posts of Deputy District Attorney, is as under:

    • 1. LLM or equivalent qualification from a Recognized University by HEC and five years active practice as an Advocate; or
    • 2. LLB (with 50% aggregate marks) or equivalent qualification from a Recognized University by HEC and Ten years active practice as an Advocate.

    Minimum Experience: 05 years for LLM and ten years for LLB.
    Age: Male 30 to 40+5 years and Female 30 to 40+8 years.

    LLB (3 year) , BA-LLB(5 year)

    Preparation of BAR ASSOCIATION exams to get license.

    All India Bar Examination
    AIBE is a national level exam which is organized by the BCI and has been designed with fulfilling the objective to assess the capability of advocates who have a strong desire to practice law in India. This examination is conducted semi-annually and tests advocates on procedural and substantive law. The AIBE will appraise skills at a fundamental level and fix a minimum benchmark for admission to practice law. After passing the examination, the candidate will be awarded Certificate of Practice (CoP) by the BCI, and they become eligible to practice law in India.

    The eligibility perquisitesfor the AIBE are set by the BCI. If the BCI realizes that an applicant is unqualified, then their application will be disqualified. Therefore, candidates must check the AIBE eligibility perquisites prior to filling the application form. The eligibility criteria that candidates must know prior to applying for the AIBE exam are

    • Only Indian resident candidates are eligible
    • The aspiring candidates must have completed their three-year or five-year LLB degree program from any recognized university
    • Candidates must be enrolled with any SBC (under Section 24 of the Advocates Act 1961)
    • He/she should have an advocate ID Card/enrollment card issued by the State Bar Council.
    • Some of the other essential points to remember are:
    • There is no age limit to appear for the exam

    Eligibility Criteria for LAW/Legal Officer

    To become a Legal Officer a candidate needs to have qualified graduation or post-graduation in Law (LLB or LLM) from a recognized institution or university. A candidate must have registered with Bar Council of India as an Advocate and few years of working experience of legal works in any court.

    To become a Legal Officer a candidate’s age must fall into the range of 21 years to 35 years. However, the upper age limit could be 40 years or more in case if the appoint is to be done on contract basis. The reserved category (SC / ST / OBC / PWD/ ExSM) candidates get relaxation in upper age limit according to the rules laid down by the Government.
